Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Deal ResQ Pro mobile application and website ("Service") operated by Deal ResQ Pro LLC ("Company," "we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years of age to use Deal ResQ Pro. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

2. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@dealresqpro.com if you suspect unauthorized account access.

You may not create accounts on behalf of others, use false information, or create multiple accounts for abusive purposes.

3. Subscription & Billing

Deal ResQ Pro is offered as a subscription service. By subscribing, you authorize us to charge your payment method on a recurring basis at the then-current subscription rate until you cancel.

• Subscription fees are billed in advance on a monthly or annual basis
• You may cancel your subscription at any time through the app or by contacting support
• Cancellation takes effect at the end of the current billing period — no partial refunds are issued for unused time
• We reserve the right to change pricing with 30 days' advance notice
• All payments are processed by Stripe and are subject to Stripe's terms of service

Credits purchased within the app (for AI features such as Flip Blueprint generation and ARV lookups) are non-refundable once used. Unused credits expire if your subscription lapses.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse engineer, decompile, or extract source code from the app
• Use automated scripts, bots, or scrapers to access the Service
• Share your account credentials with third parties or resell access to the Service
• Submit false, misleading, or fraudulent information
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to any part of the Service or its infrastructure

5. Intellectual Property

All content, features, and functionality of Deal ResQ Pro — including but not limited to the app design, text, graphics, logos, AI-generated analysis, and software — are the exclusive property of Deal ResQ Pro LLC and are protected by copyright, trademark, and other applicable laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal real estate investment activities. This license does not include the right to reproduce, distribute, modify, or create derivative works from our content.

Deal data and renovation plans you enter into the app remain your property. We claim no ownership over your deal-specific inputs.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Service will be uninterrupted or error-free; (b) any AI-generated estimates or projections are accurate; (c) the Service will meet your specific requirements. All financial estimates and renovation cost projections are approximations for planning purposes only.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEAL RESQ PRO LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS LOSSES — ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claims arising from or related to the Service shall not exceed the total amount you paid us in the twelve (12) months preceding the claim.

8. Indemnification

You agree to defend, indemnify, and hold harmless Deal ResQ Pro LLC and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

9. Third-Party Services

The Service integrates with third-party services (Stripe, Supabase, Anthropic, Rentcast). Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the practices of third-party services.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion. You may terminate your account at any time by contacting support.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimer of warranties, and limitation of liability) shall survive.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in [Your County, Your State].

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via in-app notification or email. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
